Court stops enforcement of Ganduje’s suspension from APC

All parties involved in the suspension of the national chairman of the All Progressives Congress, Abdullahi Ganduje, have been stopped by a Federal High Court in Kano, presided over by Justice A. M. Liman, from enforcing the suspension.

Haladu Gwanjo and eight others were barred by the court from implementing the purported decision made during the alleged emergency meeting of the supposed executive members of the APC Ganduje Ward in Dawakin Tofa local government, which took place on April 15.

Recall that Justice Usman Na’abba had on Wednesday, April 17, granted an ex parte order restraining the national chairman of the All Progressives Congress, Abdullahi Ganduje, from parading himself as a member of the party. This came after an ex parte motion filed by Dr. Ibrahim Sa’ad on behalf of two executive members of Ganduje’s ward, Dawakin-Tofa Local Government Area, the Assistant Secretary, Laminu Sani, and legal adviser, Haladu Gwanjo (plaintiffs), who were part of the nine ward executives that suspended Ganduje on Monday, April 15.

However, Justice Liman has now issued an order barring parties involved in the suspension from enforcing it pending the hearing in a substantive suit on the enforcement of the fundamental human rights of the APC National Chairman as subsumed under Section 46 of the Constitution of the Federal Republic of Nigeria.

It read; “That all the Respondents, their servants, agents or privies are hereby restrained from implementing and or given effect to the purported decision reached during the purported emergency meeting of the alleged Executive members of APC Ganduje Ward, held at Ganduje Ward of Dawakin Tofa Local Government Area of Kano State on April 15, 2024, pending the hearing and determination of the substantive application for the enforcement of fundamental rights of the Applicant.

“That all the parties are hereby mandated to maintain status quo before the purported emergency meeting of the alleged Executive members of APC Ganduje Ward, and to stay all action in respect of this matter pending the hearing and determination of the substantive application.”
